Preamble

These General Terms and Conditions of Sale (hereinafter referred to as "T&Cs") govern all sales concluded between Emotions Chocolats and any buyer (hereinafter referred to as "the Customer") via the www.emotionschocolats.be website or in physical points of sale.

Any order implies full acceptance of these T&Cs. Emotions Chocolats reserves the right to modify the T&Cs at any time; The applicable version is the one in force on the date of the order.

Article 2 – Products

The products offered for sale are those appearing on the www.emotionschocolats.be site at the time of consultation by the Customer. Each product is accompanied by a description indicating its essential characteristics (composition, allergens, weight, etc.).

Our products are handcrafted. Slight variations in shape, colour or weight may exist from one production to another; they do not constitute a defect.

Emotions Chocolats reserves the right to modify the assortment at any time, in particular according to seasonality and the availability of raw materials.

 

Article 3 – Prices

Prices are indicated in euros (€), including all taxes (Belgian VAT applicable). Delivery costs are not included in the price of the products and are stated separately when ordering.

Emotions Chocolats reserves the right to modify its prices at any time. Products are invoiced on the basis of the price in force at the time of validation of the order.

 

Article 4 – Order

4.1 Online Ordering Process

The Customer selects the desired products and adds them to the shopping cart. Before validating their order, they check the summary (products, quantities, prices, delivery costs) and fill in their delivery and billing details. The order is confirmed after effective payment.

A confirmation email will be sent to the Client as soon as possible after receipt of payment.

 

4.2 Availability

Our products are offered while stocks last. In the event that a product is unavailable after the order has been validated, the Customer is informed by e-mail and can choose between a substitute product, a credit note or a full refund.

 

4.3 Modification or cancellation

Any request for modification or cancellation must be sent as soon as possible to info@emotionschocolats.be. We do not guarantee the possibility of modifying an order that is already being prepared.

 

Article 5 – Payment

Payment is made online via the secure Mollie platform, which offers the following methods:

•        Credit card (Visa, Mastercard, Maestro)

•        bancontact

•        Bank transfer

•        iDEAL (subject to availability)

 

The Customer's bank details are processed directly by Mollie BV and are never stored by Emotions Chocolats. The transaction is secured by SSL encryption.

The order is only taken into account and prepared after full payment has been confirmed.

 

Article 6 – Delivery

6.1 Delivery Area

Emotions Chocolats delivers in Belgium and, subject to availability, in neighbouring countries (France, Luxembourg, Netherlands, Germany). For any request for delivery outside the standard area, contact us in advance.

 

6.2 Delivery times

The indicative delivery times are specified when ordering. They run from the confirmation of the payment. Emotions Chocolats strives to meet these deadlines but cannot be held responsible for delays attributable to the carrier or exceptional circumstances.

 

6.3 Shipping costs

Shipping costs are calculated based on the weight of the order and the destination. They are communicated to the Client before the final validation of the order.

 

6.4 Heat-sensitive products

Artisanal chocolates are heat-sensitive products. Emotions Chocolats takes all the necessary precautions to guarantee the quality of the products on delivery (suitable packaging, shipping avoided during hot weather). The Customer is invited to open their package upon receipt and to store it in a cool place (between 15°C and 18°C), away from light and odors.

 

6.5 Receiving and Verification

The Customer is invited to check the status of their order upon receipt. In the event of a damaged package, he must express reservations to the carrier and contact us within 48 hours of delivery by e-mail to info@emotionschocolats.be, attaching photos of the package and the products concerned.

 

Article 7 – Right of withdrawal

In accordance with Article VI.47 of the Belgian Code of Economic Law, the Client has a period of 14 calendar days from receipt of their order to exercise their right of withdrawal, without having to justify their decision.

 

However, this right does not apply to the following products, in accordance with Article VI.53, 4° of the Code of Economic Law:

•        Foodstuffs likely to deteriorate rapidly

•        Products made to consumer specifications or clearly customized

 

Thus, food products such as chocolates, pralines, spreads and ice creams cannot be subject to a right of withdrawal if they have been delivered and their conservation or hygiene is likely to be compromised.

Apart from these exceptions, to exercise your right of withdrawal, contact us at info@emotionschocolats.be. Products must be returned in their original packaging, unopened and unused. Return shipping costs are the responsibility of the Customer.

 

Article 8 — Warranties and Claims

Emotions Chocolates warrants that its products are as described and free of hidden defects at the time of delivery.

In the event of a non-compliant or defective product, the Client has 2 years from delivery to assert the legal guarantee of conformity (Belgian Civil Code). He must contact us as soon as possible in info@emotionschocolats.be describing the problem precisely and attaching photos.

Depending on the case, we offer a replacement, a credit note or a refund.

 

Article 9 — Allergens and nutritional information

Our products are made in an artisanal workshop that handles the following allergens: milk, gluten (cereals), nuts (hazelnuts, almonds, cashews, pistachios, etc.), peanuts, soya, eggs.

Cross traces are possible. The full list of ingredients and allergens is indicated on the label of each product. People with food allergies are welcome to contact us before ordering.

 

Article 10 – Liability

Emotions Chocolats cannot be held responsible for:

•        Damage resulting from improper storage or improper use of the products by the Customer

•        Delays in delivery attributable to the carrier or force majeure events

•        Temporary unavailability of the website

 

The liability of Emotions Chocolats is in any case limited to the amount of the order concerned.

 

Article 11 – Protection of personal data

The processing of personal data collected in connection with orders is governed by our Privacy Policy, available on our website at www.emotionschocolats.be. In accordance with the GDPR, the Customer has the right to access, rectify and delete their data.

 

Article 12 — Intellectual property

All elements of the www.emotionschocolats.be site (texts, images, logos, recipes, graphic charters, etc.) are the exclusive property of Emotions Chocolats and are protected by copyright. Any reproduction, even partial, without prior written permission is strictly prohibited.

 

Article 13 — Applicable law and jurisdiction

These T&Cs are subject to Belgian law. In the event of a dispute relating to the interpretation or execution of these Terms and Conditions, the parties undertake to seek an amicable solution before any legal action.

In the absence of an amicable agreement, any dispute will be subject to the exclusive jurisdiction of the courts of the judicial district of Emotions Chocolats' registered office, unless otherwise required by law.
